Federal Court cancels the open meeting of the Council of Representatives and is obliged to convene within 15 days
BAGHDAD (Alsumaria News) - A Federal High Court in Iraq, a decision to cancel the decision of the President House of Representatives interim Fuad Masum, making an open meeting of the Council and shall be obligated to resume the meetings of the Council during the next two weeks.
The head of the Federal Court Judge Medhat al-Mahmoud told a news conference at the headquarters of the Court attended "Alsumaria News" that "the Court made the decision to cancel the decision of the President of the Interim Parliament Fuad Masum, making the parliamentary sessions are open," indicating that "the Court issued a binding decision of the infallible resume meetings parliament during the next two weeks".
Al Mahmoud added that "the Federal Court decision came after a meeting of the nine members of the court to decide on the application of wisdom about the case is submitted to cancel the open sessions of the parliament," noting that the parliament will be resuming work under article fifty-fifth session of the Iraqi Constitution."
A number of civil society organizations have in the month last August, filed a lawsuit in Federal Court against the President of the Interim Parliament Fuad Masum on demand to cancel the open meeting and shall be obligated to resume the meetings of Parliament, the election of a new speaker and two deputies, but the court decided to defer consideration of the issue to the nineteenth of the month of September, and then decided to postpone this date to consider it also to the nineteenth of the month of October now.
Article ninety-third of the Iraqi Constitution that the terms of reference of the Federal Court is to control the constitutionality of laws and regulations in force, and the interpretation of provisions of the Constitution, separation of issues that arise from the application of federal laws, resolutions, regulations, instructions, and procedures issued by the federal authority, and adjudicating disputes that arise between Federal Government, the governments of the regions and governorates.
Under article 94 of the Iraqi Constitution that the Federal Supreme Court's decisions are final and binding for all authorities, and formed a court official under the Law No. 3 of 2005.
